Exchanging BRAND New Replacement with different kind of Phone - Networking

Hi, So I have been talking with an AT&T Rep through email/Phone (The Same Guy) About my LG Nitro and Service Issues. Well he went ahead and SENT me a new phone(Not referb). Well anyways he said since the phone is new when I go to activate it(They want me to activate it with the toll free number with new sim and everything) that they will charge the upgrade fee (But he said he would take it off for me) then change my Upgrade date to the day that I activate it since it was new.
I got it through the mail today. and it has a receipt it all says $0.00 but at the bottom it says Return Policy saying I can exchange/Return within a certain amount of days. Do you think the store would let me do so?? To say get a Galaxy Note?
And no I WAS NOT DUE for an upgrade I used it LAST Month. But its technolty renewing my contract when activing this phone.
So do u think it could be done? I would go in to the store but I DONT Want to WASTE a trip. Its about an hour away.

Can't you Just put ur old SIM in this phone? It's what I would do. Then it wouldn't renew your contract. To answer your question I think you might have to call the store and, ask.

I beleive that there is a "waiting" period when you do something like that. I have heard it is sixty days.

i work for sprint and alot of people have called and asked the same question..... so here is your answer that you are not gonna want to hear.
if you cancel you line and you only have 1 line on the account then you will have to wait 60 days before you can open a new account.
but if you do it the right way u can still get your evo on june 4th . you can go to sprint today and open up a second line but dont buy a phone there start the new line with another sprint phone that you already have (or buy a cheap one off craigslist) and then wait till tomorrow and cancel the original line. on june 4th go to radio shack or Best buy (since its only 199 there) and do an upgrade on the new line. you are able to upgrade since sprint did not provide you with a phone when you started your new line... i hope that wasnt confusing for you, if you have any more questions, feel free to ask...

If you were approved for more than one line when you signed up, you can add the evo on one of those other lines, and then cancel the original line (though if its over 30 days you'll have to pay the etf, but you could just sell the hero to cover that cost. That would be the easiest way.

Early upgrade for the EVO

I wasn't due for an upgrade for another month but the local Best Buy had some white and black ones in stock, so I called Sprint and they moved my date up a month so I could go ahead and upgrade. This was 21 months in on one line and 11 on the primary line for the upgrades. Just thought if you are due for an upgrade then it might be worth your time to call Sprint and see if they will move your upgrade date so you can get the EVO if you can find it.
You just got lucky that you had a cool rep to do do that for you. I tried and they wouldn't go for it when they first came out. I had to pay an early termination fee for my Touch Pro in order to get my EVO.
When in doubt Sprint will always let you upgrade at least one month early. One thing you can do is call, talk to a manager and tell them how badly your current handset blows and you wanna upgrade. Normally you'll get some grief at first but if you threaten to cancel service and tell them you'll get an iPhone than they submit to your wants.

I was behind for an upgrade when I got mine. I just told sprint my problems with the pre and was really liking the evo, and would be willing to sign another 2 years I'd they could renew my upgrade date. I got my pre like 14 months ago. It helps to tell them that you're trying to decide on the evo and a phone on another network, for me it was the droid.

If you are with Sprint enough time, you can upgrade every 11 months. not even 12.
And I don't think any other company does that.

I've been with Sprint since before it all became digital and the days of the brick phones so if that's not long enough, I don't know what is.
I wasn't due for an upgrade until Sept 1, went to best buy on June 20th and they said I was eligible.......
If you pay over like 120 or 130 a month for Sprint service than you are a premier member. One of the perks of this is upgrades every year vice 2 years. You're also supposed to get priority in store service and you get accessories for like 25% off. There's more, just go check it out on Sprint's site.

you're lucky. i was 3 weeks early to renew my contract as a premier member, but they would not renew it since i was getting an evo. they wouldn't even sell it to me straight up. i even got into an argument with the manager because i was getting different stories about me upgrading and/or purchasing the phone for full price. they only wanted new lines for the evo.
I had a week to go for my upgrade, but Sprint would not budge. I contacted the retentions department and the rep said the only way they would move my upgrade date up is if I had the BB representative call customer service and tell them that my phone was broke and that I was looking into the evo. Essentially they could replace my current phone and I was only going to keep it for a week and get the evo or they could save some money and move my upgrade date up. The customer service rep didn't resist the move.

This is exactly what I'm talking about. I had to go through BB and open a new line on my account as a family plan. This is where Sprint falls short. Evidently in my area they don't practice what they preach. My Touch Pro broke a week before the launch of the EVO and I was even charged an early termination fee on a broken phone. This alone almost swayed me to go with Verizon but decided to give Sprint one more chance.
I was planning on adding a new line anyway when i was gonna get the evo. So when i went in telling the rep at the store i wanted just a case he asked why i wasnt getting the phone through them, to which i replied. i pre-ordered from best buy . 2 of them (one for me and one for my buddy). The rep asked how much i had put down i told him 50 bucks. he told me he would match that if i bought through them. I kinda hesitated, and told them i had pre ordered 2, to which he answered, we'll match that also. I went ahead and got them from the sprint store. thats not the best part, they gave me all sorts of discount (23% off my phone bill) and when i went to look at my phone bill the new line is already ELIGIBLE for an UPGRADE. and the old line i had (the Hero)is eligible in october, and they told me that i couldnt change main number or id lose the upgrade on the hero, but my evo is now my main line.. LOL i guess i win LOL. when the new phones come i dont have to wait or Early Terminate. HAHAHA

T-Mobile's Stance on Returned G2's for those who extended their contract.

Today, I called T-Mobile because I returned my unresponsive G2 and wanted to go back to my previous state of not having a contract. I was within my 14 day grace period for my device so I believed that my contract would also be reverted back to the original status.
The customer retention guy with a heavy southern accent said that I signed a new contract for both the phone and the service... So If I want to be out of the contract, I need to pay a 200 dollar early deactivation fee because the contract with a new phone and the service is two separate contracts. How unfair is this? I extended my contract to get a discount on the phone that stopped working after a few days. Now I can't get back my non contract status??? This is so ridiculous.
I told the guy that I will cancel my account and go with ATT+ the iFail and he promptly told me that I will be billed 200 dollars plus any service usage. I asked to speak to his supervisor and he said he was a supervisor in a very coy and belittling way. I proceeded with "you can take that bill and stick it up your ass you f*ck" and hung up. Am I really obliged to pay that 200 dollar deactivation fee? Anybody here know how this works? I'm so frustrated and angry at T-Mobile for treating a long time customer like this... I was thinking the service contract extension and the phone are together as one. Any suggestions?
No, if you returned the phone within 14days you return the contract extension also. I did this when I bought my Vibrant. I bought it with a contract extension, then returned it and went on to buy another Vibrant from costco at a stupidly cheap off contract price. On the return of my Vibrant to the T-mo store I was refunded the price of the phone and my contact extension was reversed. I am currently still off contract and can upgrade if I choose to.
As the poster below says... be nice but firm, know your rights.
Call back and try another rep. Bit of advise though, comments like that just make the situation worse.

Talk to loyalty representative. (Every rep is different, the other guy might've been an ignorant idiot)
If they don't budge & you are within your Still 14 day return policy call t-mobile, repeat the same process BUT this time have your call recorded (you shouldn't tell them b/c they will say they can't talk anymore and hangup, even though They CAN & Do Record your calls)... also be sure to bring up the issue during the call and bring up the day it is etc. (build your case within the call)
File a complaint with the BBB... companies take that seriously.
Make sure you word it so that it is EXPLICITLY Clear who's at fault & Why & provide some emotional appeal... you can mention your call was recorded and you have evidence (even though it May not be legally acceptable)
Your issue will get resolved.
I got in a dispute w/ Dish Netw0rk [contract issue] and had to go the BBB route to get my issue resolved.
btw don't get mad at them or tell them something that can bite you in the ass later... they make a lot of 'Notations on your acct' and other reps will refer to it in the future and may assist you based on that.
Call corporate. I called 6 times to a CSR at tmo to return that piece of crap vibrant and they all told me I couldn't return it even knowing of the issues it was having at the time. I called corporate tmobile and they settled it within 5 mins. Shipped my phone back, got a full refund, and got a g2 discounted at upgrade price when I wasn't even eligible for one.

Also I didn't have to hassle them at all. They offered me all that. My word of advice is make sure you state when you call you want to speak to someone in corporate. I called once and said I needed to speak to someone about my phone n they transfered me to the regular customer service reps who didn't do crap for me from the get go. So clarify you want to speak to someone from CORPORATE. Then you should be all gravy from there.

Always check your state laws before recording a telephone conversation. In some states it is a felony to record a phone call without the other party's consent.
Better off trying corp and seeing what happens... less of a headache.

Maybe whoever you spoke with is in new mexico, but I assure you, t mo corporate is in bellevue wa. I can't speak for where the reps are located. But that is a washington state number.

Forget corporate, forget escalations.... I had to do the same ****... Call back, say blackberry at the automated prompt. You will immidiately be connected to Tech Support. Explain it to them, they'll hook you up!
Did you change your rate plan to one of the new plans? I'm just curious because if you dd then there is a contract extension for that and a separate one if you're eligible for an upgrade. If you return your phone within the remorse period then you are still eligible to get a full discounted upgrade but are still in contract due to the rate plan change. Hope that makes sense

First of all, T-Mobile corporate offices are headquartered in Bellevue, WA. Second, that 425 area code is for Kirkland / Bellevue area. Third, I used to work for them. Believe me that number took you straight to Bellevue. You may have been transferred elsewhere, but it took you there first.

When I was out of contract, they offered the phone first and just gave me a newer plan for loyal customers. They never said I was signing off on two contracts. When a normal person that wasn't on a contract, upgrades their phone... they would expect the phone and the new contract to be included in the 14 day remorse period. If that isn't the case, T-Mobile is basically tricking you into thinking that you have 14 days to decide if you want to stay with T-Mobile, or get back to non contracted status. Pretty shady if that's the case.
Also, why do I get the feeling you work at T-Mobile? Anyhow, if you were on the cheaper, non contracted Even More Plus plan, you will have to upgrade that plan to the Even More plan counterpart which is more expensive in order to cover the discounted phone price. So you are telling me they can't go back to their old plan under the remorse period? Pretty sneaky and underhanded way of forcing us to stay or pay the early termination fee.

I don't disagree with you just wondering if they mentioned an extention for the rate plan change. From what it sounds like you were offered the unlimited loyalty plan for $49.99 and if that's the case then there is no contract for the plan. Just trying to find out the details so I can at least give some advice.
Edit: if you moved from even more plus (no contract) to even more (contracted) to get the discount on the phone then you did accept a contract for the change but if you returned the phone then there is a way to have the plan moved back. I would advise going to you nearest corporate T-Mobile store and speak to the manager and explain the situation. They have the ability to change it back to even more plus if the reason is good enough. If they don't know that they have this ability then they are unaware but they do have the ability. Hope that helps

How does remorse work in this case?

So I got a mt4g my remorse ends the 19th...I got the mt4g thru t-mobile loyalty for 150 if I wanted the nexus s would they give me the same deal?

Nope. I'm in the same boat as you. talked to retentions about that issue myself. The prob is that they put a change in the system for the transaction of the phone they are giving you to upgrade so you don't pay full price for the phone.
Since nexus is only available through best buy (third party) they can't help you. That's what retentions told me anyway. I like the mt4g but miss the extra screen real estate, and all of the ones they sent me have the washed out screen.

Were you off contract when you purchased this upgrade? If so once you return your phone your account should reflect that your contract period is expired, if that is the case you should then be able to go into best buy resign for two years and get the phone for $200. I talked to best buy about this yesterday.
what they did was wave my old contract and started it new when i phone ordered the mt4g 2 weeks ago

If thats the case then when you return the mt4g your contract should revert to the old contract. If you were past your two years you should qualify for the $200 price.
Do you have to get a data plan with the Nexus S if you purchase it with a contract?
And if so, can that data plan ever be canceled later on by calling Tmobile? For example, if I wanted to get the Nexus S as a gift, but wanted to save some money. I have a line on my family plan eligible for upgrade, say I upgrade it with that line, am then forced to get a data plan, but I give the Nexus S as a gift to someone who will use their own data plan... can I cancel the data plan that I had to purchase on my line which I upgraded with?
Just return the phone to T-mobile. They'll reinstate your upgrade, cancel your contract, put you on your old terms. Then simply go to best buy and reup through them.
It doesn't work like that, I called tmobile today, they told me to make sure with best buy because 3rd party suppliers can't see phone has been returned, I work @ bb and after shift talked to the bb mobile manager n he said the same that tmobile just puts a note on you # saying avalable for upgrade n they can't see it because tmobile doesn't update the computer...thus it can't be done so a lot of people who took advantage from remorse might not get this

All you have to do is tell tmobile your dissatisfied with the phone upgrade you used. Tell then you're going to wait until a better phone comes out a few months from now, and you want to go back to your old rate.
(that's what the remorse period is for).
Then simple stroll into best buy and use the upgrade your entitled to.
That's the point, returning the phone won't AUTOMATICALLY cancel your new contract and revert back, so BB wont see the upgrade available!

When I called to dispute, they had to call the tmobile store and they had to look up my account at the store and confirm that I returned the phone.
If they had this much prob at a corp store, you're going to have probs returning and next day going to BB to try and upgrade to Nexus S, cuz systems aren't connected and etc.

i told them and asked best buy to make sure i send the phone back or not, best buy said they can't do that, the upgrade will not show up for bestbuy it will only show up for tmobile...i dont want to pay 200 to cancel and 200 for the phone either
My problem is that I got the mt4g when I wasn't eligible, I complained about my vibrant never getting accurate gps, even after exchanges, and they gave me the mt4g for a little lower than upgrade pricing. Ifi go back and return the phone I go back to my non upgrade status anyway. Retentions just gave me a sweetheart deal for the new phone.
I guess with my 100 buck best buy card, and selling my mt4g and vibrant I could get the nexus for a couple hundred. Just not sure I should go that route. The mt4g has some awesome hardware, but having the washed out screen that's too small and a tiny rom selection is driving me crazy. If my vibrant didn't have gps issues I would just keep it and never gone this route anyway.

thats my same issue, i complained about freezing hd2 and they gave me the mt4g for 149.99
when i asked her she said i would eligible for upgrade still if i decided to wait
Sell the mytouch and pay the difference when you buy it outright. Should come out the same.

ps...make sure you are counting your 14 or (30 days in california) correctly. For example, the 19th of this month to the 19 of next month may be over 30 days! Got to count the actual days!

YES, its as easy as returning your phone and waiting for your cantract to revert. I suppose it might take a bit longer for best buy to update your contract but using that theory I could go get an MT4G 4g through t-mobile for $200 and then go get a Nexus S at best buy for $200 because that data isn't live based on what your are saying. Hell I might as well hit up 7 best buy stores in an hour and buy all the nexus s's in the area and bootleg them because best buy has no idea about my contract status.
Do then how do we go about returning a phone and getting the nexus s? I was out a contract but then got the mt4g with upgrade. I'm thinking about getting the nexus s. My remorse is up on the 26th. So would I have to return it now in order for bb to see my available upgrade? Does anyone know how long it takes for 3rd party store computers to update a contract status?

Dilemma with Verizon

Well, here is my dilemma:
My wife signed me up for Verizon, and got me the Samsung Continuum for free from them. Had I known about this, I would of definitely done more research, and got at least a phone that's not EOL. Either way, I'm sorta happy with the phone after I rooted it and it's now using Froyo.
This is all hypothetically speaking, but since I'm still in the 14 days, could I order a free phone from wirefly(probably Incredible 2 or X2) get that activated as a 2nd line, and drop my original line, and have it back as a single line with no ETF within the 14 days? I would be basically just upgraded to the free X2 or I2 and dropping this dead device I have now? Had I known all of this in advance, I would of just of went through wirefly start with, but I didn't know it was even happening until I got home from work and was handed it as a anniversary gift.
Or are there any other clever ways to get around this. Could I just drop the service I have now altogether, and then sign up again through wirefly or walmart and get the free Incredible 2?
Any help on this would be appreciated, thanks.
yes you can take it back before the 14 days are up and yull just have to pay a 34$ restocking fee then u can get whatever phone u want however you only get 2 returns in those 14 days. and i believe how the data usage goes u pay by how many nights u used it or atleast thats how it was when i returned that mifi thing.
I understand I can exchange my phone, but it was ordered through Verizon Wireless online, and if I wanted to exchange it, it would cost me $200 to upgrade to the Incredible 2. Is there a way I can return it, while keeping the service active, and order a free Incredible 2 through wirefly or walmart, and it be my main line.
Yes I was actually talking to them about doing that for me bassicly u diactivate it at the verizon store and go get whatever phone u whant and have that store activate it the only problem is the rep at the vw store looses the cometition and you won't be able to keep your number. Just talk to the sales rep at vw it maybe a hit or miss getting them to do that because of the whole commission thing.

Woah, the problem is the contract I think: you can put any device you want on your existing Verizon acct, but IIRC Wirefly requires a NEW account for their free phones.
Try walmart or bestbuy
And the contract isn't a problem because as long as your in the 14 day grace period your fine.
