It's possible if enough people let their representatives know they don't like it. But they won't. They never do. And there hasn't been a government with a spine in this country for 20+ years so it'll probably "force" AT&T to make some petty concession in return for the bazillions it'll make off it's substandard service and that'll be that. Americans are self-centered and lazy and you can take that to the bank. AT&T sure will. I mean really, an online petition? Does it get any lazier than that?

Since they aren't breaking any law, there won't ever be a government response.

If att does not let me keep a month to month plan once my contract is over with tmo,if they merge, then i will prob go with metropcs or maybe simple mobile so att can look forward to loosing my $170 a month.

Just think about most cases like this, big companies buying big companies out. When has a petition ever stopped it? I agree that its a bit crappy for US people but I Ruby there's anything that can be done abut it.

Yes, there will a response because of anti-trust and monopoly laws and prove me wrong about the rest of it. There are entire business models based on the lack of attention and laziness of consumers in this country. Rebates, for example. On the surface you wonder how anyone makes any real money with them but they do because so many people are too lazy and distracted to mail them in. When they do, the first hitch that comes along is the end of it because they don't want to have to pick up the phone and talk to someone. Hell, look at all the questions on here that ask if there's an online way to do something because they don't want to have to pick up a phone and talk to someone. Whining about it doesn't make it less true.

People are over reacting. Show me the anti-trust violation/monopoly violation. People will talk, then after a few weeks it'll be back to Charlie Sheen and his tiger blood, or Lindsay Lohan dropping her last name. Just chill. We'll all be grandfathered into our plans, and we'll be given the choice to update to AT&T when the time comes, or we'll be stuck with what we have. *shakes head at the American People these days*

I mean really, post after post, of people messing up their phones, completely their fault, even bricking it, then coming on forums complaining and trying to figure out a way to get a free replacement from Samsung/T-Mobile.
STOP IT! People like you are the exact reason phone prices will increase. With all this defrauding going on, we can kiss $199.99 smartphone price points goodbye, say hello to $400 cell phones with 2 yr contract.
Seriously, if you want to mess with your phone, that is your choice, you have a right to do so, however don't expect Samsung and T-Mobile to replace your unit when you messed it up. Root, apply lag-fix, new roms, etc...at your OWN EXPENSE.

If gps/lag wasn't so broken people wouldn't be so desperate to hack and break. These are the people who should have just returned their phones in the first place, which wouldn't have been any better for tmo or samsung. So considering they prob fit well within the returns a product like this deserves, I don't think it'll effect prices or forum members who work in the cell phone industry at all.
I'm annoyed that there isn't another phone on tmo that's worth switching to.

No, I take responsibility for my actions.
Why should someone else foot the bill? Did I not sign a contract? Am I not an adult? Adults who enter contractual agreements should act like adults, not like children.
Maybe you are on a family plan and your parents pay your bill, but as an adult I take responsibility for my actions. If you root, or do anything else that goes against the TOS of your contract and warranty, then you should also be adult enough to understand that you have entered a contract, you have agreed upon terms and conditions, and you should also be adult enough to foot the bill for a new phone when you caused the damage yourself.

What do your comments mean? Mind elaborating? Be more direct, don't be afraid.
For starters, I haven't bricked my phone ever, and I've never brought my device back fraudulently seeking an exchange.
But if you ask me, Samsung is just as much in the wrong for manufacturing and selling
devices that do not work as advertised. Once the end user is beyond the trial period, they are locked into a contract with a faulty device. Look at the progress Samsung has made in the past 10 months towards fixing the problems with the Behold II device: NONE.
Given this company's track record with supporting their mobile cellular devices, it is easy to believe that they may never fix the deficiencies with this current line, and flashing a custom ROM may well be the end user's only viable option.
Lets look at the facts.
Samsung sells a phone to all of the phone companies (behold, galaxy) and market it to have all these features. Phone companies sell these phones and they make millions from these sales. Phones are defective and all parties know this but continue selling phones and marketing them with out ever telling buyers of the devices problems. they continue to make millions. When many buyers realize that said devices are defective and complain, they say we are working on a fix, but they never say that it will be fixed just that they are working on a fix. Phone sales continue and they keep making millions with full knowledge of the fact the these devices are defective.
WHO IS DEFRAUDING WHO?
The root of the problem is a BAD design of the recovery mode.
The recovery mode MUST reside in non-erasable area and MUST be available always.
But no. Any person who owns a PC and has an internet connection can brick his phone in no time.
I am really disappointed of the way the phone is designed. In software aspect.
Samsung even keep the unlock code in plain text /I am not complaining about it/. It must be a precedent in the cell phone history.
And we all pay for it. So many bricked phones. So many replacements. So much frustration.
I'll try at least to pay less money for a device designed like this.

THEN RETURN THE PHONE and purchase another BRAND. That's your decision to keep a unit you are not happy with, and insist on fixing it yourself.
Nobody is twisting your arm to purchase it. If you purchased it, and it doesn't perform as promised, return it. Plus isn't that the real way to make a statement? I WONT STAND FOR DEFECTIVE PRODUCTS, I'M returning it and buying HTC!
NOPE, instead what do you choose to do? You choose to purchase a produt, which you admit you are very well aware of Samsungs history, which you seem not happy with. So what do you do, you buy another Samsung product. Then you mess around with it, you mess it up, you complain, you then go in a cycle of exchanges, one after the other. Ya it does actually annoy me, because I'm a consumer. When people defraud T-Mobile and Samsung, at the end it hurts all end consumers.
Eventually we will have tighter more strict returns, possibly even no returns, or returns with like 40 percent restocking fees. Cell phone prices will also increase, because of people like you, who decide to ruin it for everyone.
It is the simple truth, it was people like you that caused most retail chains to implement 15 percent restocking fees and get stricter on return policies. People like you who will cause companies with awesome return policies, such as Costco, to eventually do away with that.
At the end, your actions just ruin things for all end consumers, simple and true.
You think Best Buy, Apple and At&t are acting like Natzi's? All of you keep it up, and T-Mobile's policy will change too.

AT&T wants us to be legit and not steal tether and this and that for Wht? They cap out speeds and when we finally get good Android phones its held down by moto blurr and a bootloader that is locked..... what do we do? How can we protest this? Lol maybe we should spray paint HSUPA AND #UNLOCKMOTO on store windows hahaha. Its wrong but its the only way to hitem how theyed care... financially that's the key to slowing them down financial hits. But really how can we get their attention?

Its not that easy when you have family plans and your kind of trapped. $350 per line is a lot. Yea I might beable to fight with them and get out of it but it doesnt always work.

Corporate America is one thing, but consumers are largely at fault as well. Just look at the 'solutions' people talk about. Vandalism? These are franchises. You think that at&t store down the street is owned and operated directly by the corp? You're hurting local business owners.
The reality is, there's zero creativity on the part of irked consumers. They don't know how to get a message out, they don't know how to start a counter-culture. Today's 'rebels' all depend on 'the man' to keep in touch with each other anyway. They sit around on their thumbs signing contracts they don't read because HAVING service is all that matters at the time. We wait for competitors to sound attractive enough, but in the end brand loyalty and other principles are a higher priority.
We sit around waxing philosophical about open standards and open source and the openness of Android, but what if Android was a Verizon exclusive? Would you completely bend over and submit to everything anticonsumer about VZN just so you can proudly wear at least ONE badge of principles for supporting an open OS? Or is it perhaps better in the long run to support even the most locked down software and ecosystems as long as the carrier and the bigger picture meet ethical standards?
Frankly, I'd rather buy based on carrier FIRST, knowing that even if my platform today isn't brilliant, I'm supporting a network i'd rather see future platforms target.
We get so caught up beating off to open software that we ignore the reality that infrastructure is a 500x more important battle. And then we just betch and sob when the infrastructure isn't the way we want it.
Man up, stop worrying so much about whether something has the almighty GPL stamp of approval, and pay attention to the real war we should be fighting. And not with hashtags.

Not defending AT&T by any means but you can't seriously be upset that AT&T doesn't want people to cheat their system and tether for free or can you? I tether for free and I'd expect AT&T to not want users to do this as it takes away from their revenue something any business wants not something they want to lose.

(I would have felt better about agreeing with you if you weren't being so abrasive about it, I don't know what "manning up" has to do with it)
Regardless, there is something wrong with the current system of marketing and commercialism. Trust me, I feel bad when I sit here and complain about upload speeds when there is real tragedies happening in the world (eg. Japan) but when it comes to it, this is beyond cellular carriers and beyond truth in advertising. This is more about a global brainwash. Corporations rule the world, and we are going to regret it.
The evolution underlying the Atrix highlights the problem even more. I have unlimited data on my phone. My phone natively possesses the ability to output to a webtop. But if I dock my phone to use the webtop then I have to pay for tethering? That's absurd. And if a developer creates a workaround then I'm violating my contract? Utter bull****.
The evolution underlying the prosecution's case against me highlights the problem even more. I can buy all of the bullets for my gun that I want. My gun natively possesses the ability to kill people. But if I shoot some guy on the beach because the sun is in my eyes, I'm somehow breaking the law? That's absurd.

I agree with you on that, tethering should be free since you are already paying for the data. Since it isn't though stealing the feature (again not saying anything since I do it too) isn't going to be something they try to not stop.
I'll continue using Barnacle until I see them say something to me.

Err...what's supposed to be free? Tethering isn't supposed to be free at all...it's pretty clearly written in your contract.
And I think it's hilarious/sad that so many people are upset with AT&T that the Atrix has Motoblur, a locked bootloader, and you can't tether for free. Are you kidding? Motorola has complete control over the first 2 things and Tethering isn't free because it's a huge drain on their network and is a service they actually provide for payment.
Would you walk into Walmart and be pissed when they yell at you for stealing a TV? No...because it's something they provide a service for that you'd be trying to evade.

I think the only thing wrong with your analogy is that paying for tethering when you already pay for data use, is NOT similar to stealing a TV from Walmart. It would be like going to Walmart and having to pay to be checked out when you already have to pay for the items in your cart. They do it because people will pay for it, it is that simple. If you don't like it change carriers or become an executive at AT&T and change it.
I don’t really get the tethering for the new plans either. They give an extra 2gb and it is the same price as going over by 2gb. They should just offer free tethering and if yougo over you would still pay the overage (10gb for$ 10).

It's actually 1GB per $10, but you're right, it's the same price so why not just give us the tethering and charge $10 for every GB we go over but instead it could only be charged if we use the entire GB. Oh, I know, I'm living in a fantasy world.

Cmon guys, lets all do each other a favor and keep Sprint in business by reporting our thoughts. Remember!!!!!The responses you type, if you choose to respond, ARE public. If you want the merger to go through, and you are on Sprint, I would be curious as to why.
I don't know about everyone else but if this deal goes through, it can have negative effects for us, Sprint users, simply because we would now become the little guy and would either need to raise prices or merge with Big Red.
To be honest Verizon said they would not oppose the merger deal which leads me to think.
That they are either considering a buy proposal for Sprint/nextel
Or they are going to buy some other CDMA carriers.
They would loose their number one spot if this merger happens they must have some other plan to counter act it which would be mergers/buy outs of other companies.

Not possible it will be 2. Verizon would be stupid to not offer a porposal to Sprint. To operate jointly while keeping Sprint as a seperate company but veriozn owning a majority share in Sprint. This would allow merging of the networks as well as verizon having control of Clear then as well. Verizon would be able to switch the WiMax towers to LTE easily as well.
To be honest They could operate as two different companies and it may be accepted by Federal Regulator Due to running as two sep compaines but merging the networks. Or they Are considering do this with other CMDA operators. Why would VErizon willing become Number 2?

I SAID if verizon chooses to operate as TWO independant companies. you would have the image of 3 companies and Sprint would/may have different pricings still.
Might be a benifit on some sides. While negatives are the possibilites of TOTAl incorpoation of sprint into verizonw hich i doubt would be accpeted but would screw all of us entirely.
Still It is the only way verizon will be able to fight back. And verizon will fight back . AND STRONG.
Also 2 big companies left. offering Similar speeds and the SAME 4G technology will have to fight each other for new subsribers and will have to offer different and better services or fight back with pricings. The prices could go up or they could enter into a price war. No matter what happens there will be mergers or majority stock buyings simple as that.

thats like saying when someone is about to get run over by a car...they can either get run over or not get run over, it's their choice...obviously they are going to avoid the bad one...cmon now verizon will fight back against it and it will have negative effects on sprint because sprint will have to compete too. if their are 3 companies it would make 1 great and 2 poor, the equivilant of 2 Crickets and 1 verizon today...this is why i don't condone it...

You are right this is why i think verizon will invest in a majority share of Sprint/nextel for the simple reason of competeing. In doing so if tmo and sprint where bought out or taken over they will have to give up or sell parts of the network of spectrum in which another company will take over the number 3 and 4 spot although smaller. Either way Sprint will be affected. Sprint won't live if Tmo and att merge. They wont be able to compete. It is hard for them even now. That is why i think they will get bought in some method.

True. We do need to voice our opinions but Money tends to buy people at very high levels of the regulatory committies.
Also If sprint could scale its network better they probably would get more customers. As for now Sprint is in a limbo state if the merger goes through sprint will have to be bought by Verizon to stay competing they will just fall apart if they dont. :/ I like the prices they have now it is great prices, good phones.
I would approve of a majority buyout of sprint as LONG as it stays a seperate company. or something like that. As long as we get to keep our plans without a fuss it be fine. But that wont happen so Im opposed of the Tmo merger just because it will force companies to buy smaller ones adn f everything up.

Im not saying its bad or good. I WANT the FCC to handle it not other people suing.. THE FCC are the ones who have the power. File your claims with them. Go through them not try to stop stuff by suing. ITS A SUE HAPPY COUNTRY.. that stops innovation easily.
The FCC can deny it and even accept it even if the lawsuit is won. Simple as that. This merger will drive prices down for us. Sprint will be better off. Verizon will become competitive to steal customers away.

Anti-trust laws are partially in the purview of the FCC, and yes it can approve the merger even if the DoJ doesn't like it, but the DoJ is just doing its job at enforcing the anti-trust laws which it has complete jurisdiction of. Especially since AT&T has been broken up before

I Beat AT&T today!!

AT&T started throttling my data this afternoon. I kindy went up to my local AT&T store and asked to be put on the phone with customer service. Their phone was tied up so I just ended up using my cellphone and leaving it on speaker phone to amuse the customers and make the staff look ****ty. The employees thought i had no chance but little did they know I remember my contracts and agreements class from college. I never signed a contract with AT&T since i bought my own phone in and I never upgraded or even bought a phone through them. I explained to the customer rep that I am following the terms of the original plan that was provided to me. I explained to them that as long as I have not put a signature on any sort of agreement altering my account then you guys can't legally alter it without consent from me. They tried to say they could and I told think twice before you make your company look really uneducated. Then I told the lady I would like to speak to your supervisor. Oh i got transferred 12 times until this cocky idiot came on the phone. This guy tried to be a smart one when i was explaining the law to him. He said, "The company doesn't give a damn about a law." Then i said sir your conversation is being recorded on my phone as well as your company phone." He said "excuse me?" I said "you heard me fool. You are being recorded and i got you on speaker phone with about 35 people listening and taking notes." He thought i was lying so me being in the bad mood i was in i gathered 10 people around my phone and let them say something to him. The little girl sad "bad man!" She was so adorable. This elderly lady cancelled her service and told the man to go burn in hell. The rest just laughed. After I the elderly lady left went to the counter the guy was kissing butt for real. He said he will see what he can do for me. I told him I can just send Jim a text. He said Jim who. I said Jim Hood our state attorney general. He put me on hold and 5 minutes later he came back saying that i was correct and your data will be fully restored in 10 minutes. I told him we can wait together then. 5 minutes later i did a speed test and I got 6.8 mbs down and 1.58 mbs up. After that i told him i am glad that this was resolved but I will save the conversation for just encase this happens again. He said have a nice day and thanks for being an at&t customer. I said whatever and hung up. The customers actually clapped and the staff looked like someone died. I'm on cloud 9 at the moment. I think I should have went to law school instead getting into Networking and Computers.

Ergo they can change the terms of service at any point and you can decide to cease payment at any point. Both parties can do these actions sans penalty because, according to you, there are no contracts in effect.

Technically I was. They was not providing the service that I was supposed to get according to their terms. It was funny though. Most people who renew their contract actually agree to the shady terms. I was really mad because I didn't get a warning before I got throttled. And I got throttled at 3.022 gb according to the idiot on the phone. I think the rep using profanity in front of a bunch of customers got my data back on track to be honest. I am glad I used my cellphone to be honest. I was sure going to give CNN my conversation for real. I have to thanks the HTC developers for including the call recorder app in their sense roms. I think it is the RCMix rom.

You obviously did not read a line of those terms so, technically, you were not. I am not certain what obligations you think AT&T holds if you did not sign a contract but from my observations, it is much smaller than what you think it really is.

Yes I did. I still have the original brochure from 2006. Those are the terms that are agreed upon. I'm sure it can be googled. The terms of the data back then basically said they can cut you off because overwhelming activity. If I was crazy and used 30gb like some customers then I wouldn't even worry about them cutting me off. They didn't follow their terms and the rep cursed during a service call. What more defense could you provide for AT&T? If you want to get down to the core of throttling it is illegal to throttle unless the service is selected for certain speeds such as what the home internet providers do. I think when some attorney general gets free time on their hands they will go after all of these mobile phone providers and penalize them heavily. Sprint, and T-Mobile are the only smart major national providers so far that are making sure that they avoid trouble in the future by being upfront about their data.

The thing you don't understand is that it is classified as a product when their is no contract. The terms is what was written in 2006. A product and a service are 2 different things. That's why you see the terms prepaid service and postpaid service. They don't use product a often any more.

This throttle sh!t p!sses me off. I had a very nice rep use a dead IMEI so he could switch my grandfathered unlimited plan, which now gets throttled at 3GB's, becasue ATT refarmed the extra 2Gigs to Simple Mobile,etc.; put me on the LTE plan so I can get 5GBs which is about what I use. I would have bought an LTE device except we probably wont have LTE for another few years! Not to mention the fact Im using a malyasian Galaxy tab plus 7.0 for voice calls and data, because I dont like being force fed the bloated recycled crap options in their stores.
This is so EPIC WIN. I understand networks are changing and much more data is being used these days, but at least let us original unlmited people use a fair amount..

I would happily settle for a sneaky way to unthrottle oursleves, but they are doing it server side, so I dont think we will have much luck.
I will check with my ex but I'm sure that is the reason why. She is an attorney and she normally helps draw up contracts for local entertainers.

Send me the contract when you have an opportunity. I am NOT distributing legal advice, however, I am speaking from the perspective of an individual who is one term from graduating from a T14 Law School. I am suggesting so as you are misleading individuals.
A SERVICE cannot be classified as a PRODUCT in any legally binding terms or agreements (it can, but is unenforceable). Regardless, that is moot as you hold no legally binding terms nor agreements with AT&T. You are still ignoring my previous comment that AT&T can shut off your service tomorrow because there are no legally binding agreements between the two parties. AT&T can throttle you anytime they would like and you can stop paying them anytime you would like as neither of you are constrained contractually.
Very nice. My mom has them for DSL and now she got a cell phone through them. I don't understand it but they suck. Good work man.

A SERVICE cannot be classified as a PRODUCT in any legally binding terms or agreements (it can, but is unenforceable). Regardless, that is moot as you hold no legally binding terms nor agreements with AT&T. You are still ignoring my previous comment that AT&T can shut off your service tomorrow because there are no legally binding agreements between the two parties. AT&T can throttle you anytime they would like and you can stop paying them anytime you would like as neither of you are constrained contractually.

I got it. My ex has been an attorney for 4 years so I take what you say with good vision but experience is supreme. I was partially wrong in my argument. According to her the basis of it is consumer protection laws and AT&T's own terms. My plan which is not a contract but it is a post paid plan. Since I have never put a signature to give consent to any changes I am only held accountable for what is on the brochure for 2006. The brochure which you can find online clearly states that the provider can cut my phone off if I abuse the network in anyway. Throttling is not introduced in 2006 buddy. No one can be held accountable for a contract they never seen let alone never signed. AT&T would have to completely shutdown my phone and release me from the usage of their network according to the brochure. It can be found on google if you are looking for it. As far as misleading the community I did explain but I think most of them might understand it now. So I apologize for not clearly explaining why I can't get throttled. If you are upset because you may have gotten messed over by AT&T or you may have a part time job with them then all I can say is get over it. You are the only sore one out of the bunch.

Yup because I thought something was wrong until I switched to my inspire then I knew I was throttled. Yes I did go to the retail store because there is an order to do things and I have learned that in order to get your voice heard you have to make them hear you. Call me crazy but I have no time to play phone tag with anyone. You can sit back if you want to and let them control you at will but with me they are going to have to stick with what was on the brochure of plans they printed for customers to stare at.

I actually wish that could happen. I honestly would be with big red if their network wasn't mainly cdma. The voice coverage is the best in the business.
