Hey guys i was on twitter and i saw this, basically T-mobile is capping us at 5gb a month of data, and if we exceed this monthly they will slow down our internet speeds to make sure users experience fast speeds all around. Each month is a fresh slate, what does everyone think of this?

T-Mobile had become the only top-tier carrier in the US to endorse data throttling over capping back in April, and at the time, we'd thought the feature was being turned on immediately -- but new communication being passed around internally has us thinking that they're just now getting around to flipping the switch. A screen up on TmoNews says that the policy will start this Saturday, October 16, after which exceeding 5GB of data usage in a month will result in "web browsing capabilities... at slower speeds... which will be determined by [the user's] device type." If it's any consolation, the same screen says that less than one percent of users will actually be affected in practice... and something tells us most of you know who you are. But hey, getting throttled is still better than getting slammed with overage, right?

Personally I don't think its that huge of a deal. I mean really, how many people will use over 5GB of data? I use my HD2 constantly, and barely use more than 1GB a month. And its not like they are making us pay for going over that 5GB, the speed just drops a little bit...so all around its not that bad.

i agree too, i just checked my statements and i used around 250mb so i couldn't imagine using 5gb a month either. I wonder what the data speeds will be for those who have gone over 5gb?
I think this is also a way to enforce the lack of tmousa built in wifi tethering.

tmobile left out wifi tethering from there stock roms on purpose, they do not want us using their network for other mobile devices. The only way i was able to use wifi tethering was by installing a cab or custom rom. I think we can agree those who use wifi tethering regularly on their phones use much more data monthly, therefore by tmobile imposing this it will act as a cutoff for those using it.

let us know what happens next month when you exceed 5gb, i wonder how much they will limit your data speeds.

I exceed 5gb a month but i tether with it all the time, also the HD2 comes already tether ready, just plug it in the computer and select Internet sharing.

well when i went over they sent me a text message saaying i already exeeded my data for the month and my speeds will be reduced. when i first went over i couldnt play youtube and the webites would take a while to load but it aint that bad for me idk if thats the case with anyone else. i use my hd2 to tether alot since i go to school and download a few things here n there.

I read in another post post (op said he works for tmo) that the speed will drop to normal edge connection once you reach the 5 gb cap.

I use my phone to tether like mad with my laptop (and yes the stock rom includes the tethering option) and i don't see myself over 3GB/mo

My buddy broke this cap several times using his g1 and later his click when tethering. He would get the text from t mobile, and his speeds dropped to 50kbps (dial up speeds)

they should get rid of this rule, i used the teather feture for internet use on my computer, once you go over the speed dropps significatly, i can bearly use my internet on my phone waiting about 2-3 mins or longer for a page to load

Yeah i have noticed the same thing, i tether on occasion. however about 2 months ago i tethered ALL the time just trying to hit that cap to see what would happen and when the bill came i just barely got there about 4.5gb of usage.
Mind you this was doing just about everything high bandwidth i could think of on purpose, tons of youtube videos, etc. the only way i can think of to quickly hit that would be torrenting. if you are torrenting on your cellphone then you deserve to be cut off. Aside from all the data transfer, torrents broadcast tons of smaller packets to many many clients, that has gotta reek havoc with a cellular infrastructure
If youre gona torrent use your land based broadband or your neighbors open wifi, youre a fool if you think somehow they arent going to be able to track you down by your cell phone's IP

I watch youtube, visit forums, and download tweaks from xda.
I doubt you guys are trying as hard as you claim to max out your gigz.
I use this phone to surf the net because holding a sleeping baby does not work sitting in front of a conventional p.c. or laptop.
They like to be walked around, and will awaken if you stop or sit down...
This is the best way to surf...well used to be.

walking a sleeping baby... sounds like youre at home, so why not use wifi? it would likely be faster than 3g, and prob save your battery some too, since wifi at most transmits a quarter watt, vs a cellular radio broadcasting a watt or more. If you dont have a wifi AP, spend $50 on a new one, or you can probably pickup a used B access point from ebay for like $5 which would be more than adequate for the HD2

good point, we are hardwired here but going wifi for the phone is a thought with the tethering in play.

wtf? tmobile, is this even legal?

I reached my 5GB cap for this month and its not the first time. Last month i reached it watching youtube and doing heavy browsing and got a text saying my speeds will be slowed. Everything worked like normal and witness no slowness whatsoever. But this month i got the same text and im unable to go to anywebsites. it says the webpage is not available. the only thing that works is tmobile, google, or yahoo but that is it. if i try ford.com, xda forums, mustang forums, anything else i try and nothing works. So i called T-mobile and they told me that its because i reached my 5GB cap and since my speeds were really slow that my websites are timing out... WTF????? its unlimited browsing, i understand theres a cap but even so i should still be able to do "slow" browsing right? not make it so i cant access anything and say its due to it timing out, i could try fast servers with good load times and still wont work... leaving me to think google is just a simple cache of the site.

For slow browsing switch to GSM only in the network settings.
This is exactly the argument someone needs to present in a lawsuit. Throttle=limited

I've tried to argue this point before, but people seem to not understand. Throttled essentially equals LIMITED DATA.
See, although your contract is for unlimited internet, and not unlimited 3G internet, people need to realize that when speeds are throttled, the internet is rendered useless.
For me, if I manually go into my phone and switch it to GSM only, or if I'm in an area without 3G, and only EDGE, my internet is rendered useless. The speeds at times are soooooo slow on EDGE, that webpages fail to load.
This is the angle someone needs to present in a lawsuit. It needs to be made clear that when speeds are throttled, this in turn in effect is essentially turning OFF internet access for new high end smart phones.
Some people are lucky and can load full web pages on edge speeds, but not me. Every time I'm running edge, my internet is useless, sites time out before they load.
I've never met my 5gb limit, but it sucks to know that people who tether ruined it for everyone. It still angers me that people tether the 5gb they now have. Soon t-mobile will reduce that even further down to 2gb.
Anyways if someone brings a lawsuit, they need to show the judge that when the phone switches to throttled speeds, the internet capability is rendered useless since most sites require faster speeds to load. In essence throttle=limited. I think using this angle a lawsuit against T-mobile can lead to victory.
T-Mobile should have put its resources into cracking down on individuals who tether, instead of punishing everyone.
One last thing, it amazes me that people are sooooo into the 4Gwars going on between different carriers. Man consumers are down right stupid. Why do you need 4G speeds when this just means you are going to watch more youtube videos and do more bandwidth intensive stuff, and reach your cap even quicker.
I guess consumers are crack heads. They sit and justify why T-Mobile should continue advertising its non-4G network as 4G, instead of being angry that the consumer is being tricked. Also who cares if Sprint isn't 4G either, Sprint should be fined and be forced to switch the advertising back to 3G, don't justify bad behavior.
Really who needs 4G when there is no such thing as unlimited internet anymore, just so you can reach your cap faster? "Oh look I have 4G, I can now watch videos at light speed but means I'll reach my 5GB cap by 5pm." ummm ok stupid if you ask me.

It's not a cap issue.
DNS is down and even (for some unknown reason) openDNS does not work either.
The feds just took down/took over a few hundred torrent and pirate sites and I *think* they were taken over at ICANN level so DNS will be buggy untill the servers refresh.

just to add, i reached the 5GB using the youtube on the phone and doing browsing as well. i did not tether at any moment, i just mentioned the blocking because at first i thought tmobile messed up at blocking tethering and blocked peoples network data... but i found a solution to being able to load sites and that is to download the Opera Browser from the market. Seems to work like a charm but still not the same experience. and websites loads extremely quick as well with the opera app.
Use IP addresses instead of domain names.
Example 192.168.0.1 instead of localhost.
Google (for some reason) always seems to work when dns is down.
You can google for "ip address [site name.com]" and then just type the ip into the browser bar, a small hassle but it'll be gone in a few hours or days at worst.

Do you have a link to the article on Feds taking down pirate related sites, i'd like to read more about this. Btw: Using The ip address worked but its just too much work and really annoying so id rather hold off till things get back on. Thanks Though!!!
Well i've tried doing the gsm only and i can only get news feeds and push mail other than that the internet is just plain useless. Welcome to 1999 to the wap era.
Tmobile at least gives you 5gb while others like att make you pay if you go over. I'd rather go with tmobile but throttled down to edge stupid is plain useless at least give me 20k/s to load webpage 2k/s which is what i get with edge is just plain stupid.
I don't know there is nothing we can do about it, all the 4G crap is just fluff, if anyone can answer me what good gives a connection that you pay $30 a month and you reach your monthly limit allotment in 1 hr. FFS i burn through 1tb monthly on my home connection and my isp hasn't said a thing.
You must have the limited unlimited plan. You need to upgrade with the unlimited unlimited plan...

By that standard, even 3G is LIMITED DATA, limited to 3G speed at 24hrs/day for the duration of a month. There's no such thing as infinite data unless you have a way of stopping time or getting infinite bandwidth. Their definition of "unlimited data" is that they'll never cut you off completely, and that's true.
As for the OP's complaint, I don't know what to say. I have no issue surfing on EDGE. Is it fun? No, but it's more than adequate for most websites. If you're timing out on all websites, you're just in a ****ty connection area. Remember that EDGE, just like HSDPA, can vary in speed, so chances are you're just in a ****ty area when you're getting these timeouts.

And you would lose your lawsuit even before summary judgment. You would essentially have to argue that 2G is not usable for internet access in any nominal sense, and that claim is absurd (unless you can make a showing that there was no such thing as mobile internet before 3G was deployed).

That's not true at all. Modern circumstances would be taken into account (or should be) and the past is irrelevant if 2G browsing does not work in the present.

Except that it does work. Heck, even 56k modems still work. It's ridiculous and bizarre to suggest that EDGE is not usable for mobile internet, seeing as how millions of people manage to use it.

Not denying that it does work. The fact that it does currently work is the right argument, not the fact that it previously worked before 3G came along. I'm sure any sane lawyer would likely be arguing that something in the contract was violated, or there was false advertising, or something to that effect anyway.

Ok that statement made no sense. How is that limited, if you have 3G speeds 24hrs/day, for an entire month, until your billing cycle resets. Looks unlimited if those were the terms.

Maybe you don't have a problem, but even here in Los Angeles, as soon as my phone switches to Edge, I'll be lucky if I can surf websites that are heavy in content.

Isn't this what I said? I said, you would show the judge that when the phone is running under edge, internet is rendered useless because some sites will timeout before they load. Edge was fine a couple years ago. However, today, with these modern phones that are able to view full desktop versions of websites heavy in content, then YES edge does cripple the user experience, even sometimes completely failing to load these sites.
I know that is frustrating..
but....WTF can we do..

it really just depends where you are.
I dont really teather anymore, I really only did when the power goes out, because then I could still watch movies on my laptop.
even so it took me quite a bit to hit the cap.
unfortunatly I doubt we can do much about this because theoreticly edge is perfectly acceptable, (it really is for me, but I understand its not for quite alot of people) its slightly faster than ISDN 128kish in areas where you get an ok signal and near extremely low end dsl 220kish in areas where you get a great signal
but places with low signal is the problem, you can get nearer to dial up speeds or an even more useless conection.
unfortunatly tmobile is pretty clear on coverage areas...
maybe if your getting horrible edge in a place where tmobile is supposed to have great coverage, you might have a case.

Don't you have to he rooted to use the app? And, if you're rooted and running 2.2+ isn't native tethering available? Seems like a moot point to block the app... go sprint btw, they really seem to be embracing android and this whole phone freedom philosophy with this and their unofficial policy on rooted phones.

Does this really surprise anyone from the carriers that limit or throttle?
Also there is a very simple rule to think about.
If there is a way to lock it, there is a way to unlock it.
What would stop someone from side loading the app? There are places other than the almighty android market to procure such tethering apps. AT&T likes to block side loading, but I thought you could just use ADB to push files anyways.

What would stop someone from side loading the app? There are places other than the almighty android market to procure such tethering apps. AT&T likes to block side loading, but I thought you could just use ADB to push files anyways.

Nothing... you can still side load it or download it via wifi.
Regardless of workarounds, at the end of the day it is the idea behind the 'restrictions.' Or attempted ones, at that. It's the principle. It's the evil, at it's base, regardless of avoidance.

In the case of ATT, they remove the option from settings to allow apps from unknown sources. So you cannot side load apps unless you root the phone.
Just a thought.

I believe this to be a false choice.
From June through September of 2010, I self-righteously scoffed at those who "Tethered for free" using any of the workarounds to Sprint's $30.00/month Hotspot. I paid the $30,00 each month while naively waiting for Sprint to fix the 50% through-speed issue.
The open CTMS ticket xxxxxxxx-100817, to address the throttled through-speeds has become a long running joke.
I would indeed love the option to purchase an unthrottled, tethered 4G connection for my laptop, but I will not pay for something that Sprint and Clear have no intention of delivering.
Actually using Wireless Teather from my Evo on my laptop right now.

The way I see it is I pay for 4G on Sprint's network, however I do not have 4G in my area, I don't complain about that, so why is sprint complaining? are they saying were ripping them off.. because we use a free app to get service we already pay for?

Well, with Sprints new policy on any smartphone, everyone that gets any Android (4g or not), Blackberry, etc. are now paying the $10 premium data charge.
Also, it is amazing to me how providers think they have a right to tell people what they can and cannot do with a device that they own. I am just saying, this is like Comcast telling someone they can't install a program on their computer because they are using their internet connection.

Your using the network which they own. The phone may be yours but the infrastructure is not. They have every right to control or restrict the amount or rate at which use data on their network.

That is correct, without them, your phone is pretty much worthless, so yes they can and have ever right to control how the data is used on your device.

T-Mobile USA Throttling Data Usage = Bah Humbug

Just got a text from T-Mobile with "due to your high data usage we are slowing your speed for the rest of this billing cycle." I am a daily data user, on $30 "unlimited" data plan, and just a day ago downloaded and began using the Netflix app and have streamed 8 movies over hspda. Whoops. Should've used Wi-Fi. Sucks that T-Mobile is throttling their data now. May all here be duly warned. Had no idea T-Mobile was engaging in the same BS that other Co's were already committing.
Anyone else saddened by this crappy policy?

If that's being throttled.... I'm moving back to Sactown.
I'm still on the $25 Mytouch 3g plan so I don't think they can throttle me. Used more than 3gb already this month and that's before I installed Netflix. I'm testing it heavily on purpose to see if I get throttled. Will post back if I get a dreaded text about it.

Sorry to tell you but if you go over the 5GB soft cap you will get throttled unless you are grandfathered from a old truly unlimited plan, if you are lucky you and I suggest never changing anything on your plan or you will forever lose your granfathered statis.
At the OP sorry you did not know about the 5GB soft cap. But it is mentioned in the T&C's plus if you go to the T-Mobilr forums by going to t-mobile.com>Support tab>Forums you can find a butt load of threads on this topic, and I mean a butt load of them.

I expect to get throttled, but I'll never know 100% until it's tested. If they don't then yeah... I won't change anything with my plan. Was planning on staying off contract maybe anyway since my two years is almost up.

I've been on tmobile for almost 2 years and wondering how old of a plan you had to have.

dude, you're getting 10megs down?
most people on WiMax don't get speeds like that, I wouldn't worry about it if I were you, you can stream just fine any movie you want on 10mb down, lol. If that's throttling I am not worried at all.
Well I just ran another 7mb data only (not Wi-Fi) test from my bedroom and got:
Btw, I am running at wireless N on my home network when I watch Netflix though, ever since the over-lords texted me. I guess as long as they don't sock me with some sort of over-usage fees then I can't complain. Damned happy with the speeds I get on this GBX v12 rom on my HD2. Sad that HTC originally had a 4g+++ capable phone with the HD2 but dumbed it down so bad and saddled it with winmo 6.5. This phone could have been called the "First 4g Smartphone"....sorry Evo4g users.

Sorry to disappoint you, but mobilespeedtest.com is known for its inaccuracies, and your speed tests prove it. The HD2 is limited to 7.2Mbps and that's a hardware limitation. Also, T-Mobile has been throttling for a while now, and it has been in the T&C for a long time, but they had not been enforcing it until a few months ago.

To be honest i am not super positive when the actual change from true unlimited data to soft capped unlimited data (am I the only one that that statement sounds wierd to?). I will see if i can find out his weekend though, so if you have not found it before then I will let you know what I find.

It probably is fast. You could be in a bad spot with towers or there are so many users that the bandwidth is killed. Run speed tests all over and at different times and you will see it change quite a bit. I can run them back to back to back sitting in the same spot and varying speeds.

True,
I ran a speed test and got about 1.5mb down, then ran one right after and it jumped to 4mb down. It depends on a lot apparently and I would not take one speed test to mean much.

You could try Open Signal or Network Test and compare results. Good for searching for towers and other goodies.

In all seriousness chill out, the only thing that will happen is your speeds will be reduced dramatically, slower than edge speeds. It will still display "4g" though keep in mind we don't even have true 4g so get that out of your head. Messages and data don't have anything to do with each other unless were dealing with mms, then at which point you will still receive but the transfer speed will be super slow. My recommendation for when you get capped....force your phone on edge

the ITU, who decides these standards. basically after they put together the 4g standard tmob and att *****ed (and probably paid a good amount of money) to have 'advanced 3g' included as '4g'.
to the op, you may not get throttled the first time or the second, you'll get sms messages saying you are throttled. when you are actually throttled, you can expect 64kbps max. it's absolutely useless.
How do you use so much data?
I kinda disgree with LTE being able to much more atleast, at the rev Verizon has theirs. I have a mifi from them and the only difference I see is upload is better 6megs usually. Then again their network goes down at least twice a month or when they have a new LTE phone to market. Download is usually about the same if not better or I should more sustained if your tethering then on my mifi. Its both a race and frankly I was kinda disappointed to hear the CEO of T-Mobile say the were going to use some the 4bill to deploy LTE. HSPA has a long way to go before it needs replacing.

i easily can kill my allotted 4G speeds with Spotify and "Play Music".
After you go over your 5gb, your speeds will be practically unusable for any thing outside email.

this. in my experience, it takes streaming music through 'play music' one hour per day to hit 5GB in 30 days.

you must have never used ATT LTE... that **** wipes the floor with us. However, I always say.. why do you want to download so fast with an expensive data plan as theirs lol.
So Treo how fast is fast on ATT? and how long is that going to last since there are very few people with LTE enabled devices on ATT. I can pretty much say that when the new iPhone comes out with LTE on ATT their network will be flooded. VZW network was bleeding fast when it first came out too. Which begs the question how fast is to fast. Cell phones have already past 6 bonded t1s. "9" megs 10 megs is the starter package for those putting thier svrs in a data center. Is 20 megs down not enough?
In atl ATT thier dsl isn't even that fast. 6 megs is all you get. You have to step up to u-puke to get 24 megs down. That's wireline service with tv so at this point even at HSPA we are ahead which is amazing but the user isn't going to see the download speed as much surfing or checking email even netflix works fine at 4 megs. What the user "us" notice is lag when doing all the above minus netflix. The only thing other than this is if your downloading a large file etc and at that point one has to ask if that file would have been better downloaded to a laptop or desktop or if its a PowerPoint sales file or employee reviews doc etc then there's security questions involved as well that are much more easily handled on a laptop.
So at the end of all this how fast to u is fast enough. What speed do u need to be able to get all of your mobile life in a month done?
Also its usually the 3rd month your cap kicks in unless your just massively abusive. Say like hitting your cap 5 days into your billing cycle two months running. The 2gig plan their less forgiving. Just try to use WiFi as much as u can.

Well it really depends on the area, but at very strong places it ranges up to about 60+ down and 25+ up...
but their averages is about half of that 30+ and 12-15 up
Our phone peaked i think around 24? I don't remember seeing anyone getting much higher. Not sure about upload speed but it was single digit thats for sure.
our average would be in the teens for download 10-15. Yes we can get higher but their average is about doubled ours..
not sure why you're asking me how fast is too fast? and how fast is fast enough? I don't think I made any points or argument about that... lol I only said that with such a high speed data, but only with like 4gb average data plan... yeah...

yeah I was like WTF do you need all that speed for? they have a strong cap on their data plan right? lol
but yeah I'm not too worried about our data speed. I'm more than satisfied with it.
I'm pretty sure most of the measurements is done through speedtest and probably a few through sustained speeds. but I doubt these guys are gonna download a big enough file, see the transfer rate in KBps then change it to kbps (bytes to bits) lol

As for how I use that much data, well its not hard, I bike every day and use a program called sports tracker live, which tracks my rides, I also sometimes stream slingplayer to listen to the news while riding.
I stream music every so often, I tether to my Xoom or Ipad if I'm out and about.
It's so darn easy to use the data when you have the speeds.
I'm at 98% now and have yet to get a text or email, should I try the throttle trick?

My sis line(1yr old) says "Data: 1.4 GB / Unlimited (up to 5 GB high-speed data)"
Mine line(12yrs old) says "Data: 3.9 GB / Unlimited", there is no asterisk that states I have a 5gb high speed limit or any mention of a limit at all.

I have had this data plan for I dont remember how many years, but I know it was before they started talking this "high speed cap" thing. Does anyone think I may not have a "high speed cap". You might have been "grandfathered" into their unlimited plan. I know Verizon was doing the same thing right before I switched to their plan.
Verizon was unlimited before, they announced they were capping their plans and if you had a plan before that date you were grandfathered in. I'm thinking that is what happened to you.

I just got a text from t mobile that says hotspot has been blocked . Has anyone else got this email. My n4 was brought from Google so would they even be able to block it ?

They monitor useragent strings. I got texts saying that they might block me then they blocked access to Internet Explorer (but nothing else) but I just called and they changed me to Simple Choice since it was the same price as the Value Plan I was on.

you bought the phone from google, but you are using tmobiles network. you agreed to their to rules by paying for their services and by using their simcard on their network. they see everything going through their network. they have a right to do as they wish with their network. they know you by your imei number on their network. if i bought a car in ohio, but am driving it in new york, i still have to follow new yorks traffic laws or i can get fined/arrested/have my licence revoked.

Here's what happened to me when I was testing tethering. I am on the $30 100 min prepaid plan. I tethered my laptop by the CM10 native WIFI hotspot. All was well. I even used it for an hour or so to make sure I could do everything I might need. Then I tried the built in USB tether. First time I tried to use Firefox, I immediately got the invitation to add tethering to my plan. Went back to WIFI, same message.
I thought, great, now in an emergency I may not be able to use this. But - put the SIM in a different phone - no messages, tether worked fine. So I think you are right, they tie the detection to the IMEI number, not the SIM or account.

This keeps being reported, and I've seen the page as well. I have yet to be permanently blocked, though. I'm using paranoid 3.65 (july 10) and native wifi hotspot. All I have to do is disable the hotspot & re-enable it, then I'm back in
Disabling the tether and re-enabling did not work for me. I was tethering LTE, second phone was not LTE capable, if that might be handled differently??
I'm using lte, as well...on baseband .33

if you are using a custom rom, that includes the latest dalvik commits, then your phone is calculating the data used wrong, this is a known issue. i didnt use 28.57gb in a week. check with tmobiles website to get your accurate usage(if you didnt)..

Yes, occasionally, because I get faster speeds if I do When I use a usb connection I use easytether (paid version), because it stays enabled through a reboot and it works with ubuntu.

wasnt doubting you(really), i just wanted you to be aware that there is that issue, to inform you in case. many dont know and are freaking out that they used more than their allowed data.
for years i tethered without paying and tmobile doing anything. i used to average about 16-30gb data used per month. the year two januarys ago, they finally stopped me, and i played the changing the user agent game. torwards the end of last year, i got tired of the game, and ended up purchasing a tethering plan. i tell you what, its nice not worrying about it anymore

Yeah, I understand that. I'm starting to get a little concerned, but I really haven't had anything happen except two or three times I've been re-routed to the page that says I have no tethering plan or I'm over my data. If I start getting threatening calls or messages from them, then I'll deal with it, but so far I haven't had any real issues except the minor annoyance of having to disable/re-enable the tethering. Once or twice I've had to reboot my phone, too, because the speed got painfully slow. Honestly, though, for the price I pay and being able to use it in the place of a land-line isp, even if I have to deal with that occasionally for life I'm ok with it lol

Correct me if I'm wrong. You tethered 16-30gb per month using circumvention, got tired of User Agent games, then you surrendered and went with a legit T-Mobile plan that STILL LETS YOU TETHER 16-30GB/MONTH?? I need to know! lol
