HD2 on ebay - HD2 General

Hi,
I have a question. I recall 3 years ago, I bought a samsung SGH ### (I dont remember the number) off of ebay for like 175 dollars or something. I originally had a crap phone and I wanted a really small and skinny one. The phone was brand new, never been opened. A few months later, I called Tmobile and they said I did have an active and working warranty on the phone (I asked the question, when does my warranty expire, and they told me a day). So my question to you wonderful people at xda-developers: If I buy an brand new, seal not broken Tmobile HD2 or lets say a Samsung Vibrant on ebay, will it have a warranty? Now before you say something like, "warranties only apply to those that original purchased the phone from an authorized dealer," how do they know you are not the original owner of the phone? I bought an HD2 from T mobile and I am looking at the receipt and there is nothing on the receipt that corresponds to anything on my HD2. My HD2 has no serial # or SKU #. I wasn't the original owner of that Samsung and I had a warranty. This leads to my final comment/question. Does the fact that being the first person to use a sim on that device make you the only person with a warranty for that device?

If you bought the phone off of eBay, AND are not an AT&T/Cingular customer, they will not replace the phone... what is wrong with it...?

and later i found that device not accepting security code

Very few warranties cover dropped devices... There are a few though, but you have to have the warranty in place on a new device and there are some caveats to them... As for the eBay seller, I doubt that they will offer any real assistance after 4 months of usage... There are a few other options that may be available, but they all concern questionable ethics and morality, so I won't even mention them...

Yep; you're essentially screwed. When you buy something from eBay, you rarely get a manufacturer's warranty, especially if the seller is an individual as opposed to an eBay Seller (business). Even if they are a legitimate business, I too doubt they will warranty any electronic device that has been dropped.
Next time do two things--put the phone in a protective case and use a screen protector; both things are inexpensive insurance against damage.

Buy a new phone and don't try to scam Cingular/AT&T.

You cannot ask your friend to have it done, since that phone is not listed on his/her account... That is why you were originally asked for the phone number... You have to buy a new phone or pay to have your phone serviced... You can contact HTC and send them the phone and pay the cost... There is no legal way that you can have the phone repaired under any warranty agreement, after you have already damaged the product...
I hate to say it, since it has already been said... you will have to either pay for the repair, or buy a new phone...

I would think next time you will take better care. Surely you really can't expect anyone or company to pay for your breaking your own phone?? Not only is this not right I believe it to be illegal what your trying to do. Best case immoral and flat out sleazzzzzy.

Wise up, people... the phone is utimately warranted by HTC as the manufacturer of the device. They prefer to route things through the carriers because it's easier that way, but you can deal directly with HTC.
To the OP: All you can do is contact HTC and plead your case. You may need to be persistent, but they do have non-carrier and out-of-warranty service. May take 2 or 3 tries to get to someone who knows this.
Oh, and despite what some have said, if you bought if off eBay it still carries the one year manufacturer's warranty (whether or not it will cover having dropped it is another issue). They track the warranty period by S/N. I recently had one -- that I purchased off eBay -- replaced, no questions asked.

Warranty replacement
Pm me I work at the warranty exchange center in 1000 oaks california. I might be able to help. Ill give you the need t know to get the phone replaced. One drop should not caused it to trip. I've dropped the hellout of mine and it works fine.

I'm working in pc business and when we get non working device we just check for visual damages and if dont see any we bring device to manufacturer or distributor and usually we get new one (if not expired warranty time)

warranty question

all heros have 12 month warranty right? you dont need to apply for it? if anything goes wrong with your phone then you just need to contact htc ? am i right?

That very much depends on where you are physically located, and where you physically bought the device.
My phone came from T-Mobile UK, and comes with a 1 year warranty. If I have a problem with the device in that time, I should go back to the original vendor (i.e. T-Mobile UK) to seek remedy. In addition, even though I only have a 1 year warranty, my statutory rights are not affected - see this link
Bear in mind that this is going to be covered differently in other regions.

I couldn't tell you definitively.
Assuming you are in the UK, if you bought it from a UK company on Ebay and is was sold "new", then they are responsible. The same may well apply across the EU, but I'm uncertain of this.
If it was bought as second hand from an individual, the situation is not so clear, but it is probable that the original retailer should still be required to honour the warranty.

I faced that issue some time ago and i contacted htc for a problem.
well from what they told me, if the phone wasn't bought at an official htc vendor, then you have no business with htc. Only thing you can do is you can send your phone to htc to get repaired or checked but you'll have to pay for it ( even if you have a guarantee from a shop)
You should contact the store where you bought the phone. And the catch at these local stores is that you should have your guarantee and receipt on your name to be able to claim it. so buying on ebay ...... i cant say for sure

eBay + T-mobile = HTC Warranty ?

I'm planning to buy a new HD2 locked to T-mobile on eBay. The question is, even if the seller gives me a receipt, won't HTC send me to T-mobile saying u bought it there, fix it there and T-mobile will say to me that I'm not a T-mobile costumer and will decline?
I mean if something happens and I'll need a warranty

If you don't want to use the HD2 on T-Mobile you will have no warranty as you described.
If you are going to use the HD2 on T-Mobile then as long as the person you buy it from has not used it then your warranty will be good. The warranty is tied to the account that first uses the phone. The IMEI number on the phone registers with T-Mobile on the account it is first used on for warranty purposes, any warranty claims would go through T-Mobile on that account.

EVERY country has diferent rules. For example, in the states you have almost no consumer protection but in the UK you have very strong consumer protection.
If you are in the UK I can certainly help you with this.

Its not t-mobiles responsibilty. Under UK consumer law you return the device to the person/company who sold it to you and NOT the manufacturer. So, if you purchased the phone from t-Mobile, then you return to T-Mob, if you purchased from Fred Smith on Ebay, return to Fred Smith on Ebay.
The device is also expected to last for a reasonable lifetime without fault. In the case of mobiles, if they wish to sell them on 18/24 month contracts it should be reasonable for a phone to last 18/24 months.
First you need to contact them letter via recorded delivery post detailing the problem and asking them to fix or replace the device.

If its Cavallipurosangue you are talking to this is very unlikely to work. T-Mobile will want to tie this up with the customer that they have and it won't.
Acer certainly wouldn't do this for me. I purchased a phone under a company contract (and therefor not covered by consumer rights) and it turns out that phone was already registered to someone else. Acer point blank refused to deal with me, almost claiming that I had stolen property.
In both cases, its NOT T-Mobiles responsibilty (in the eyes of UK Sales of Goods Act) and IF they do repair/replace, it will only be good will and out of there choice.
T-Mobile will have a "contract" (and i don't mean 12/24 month contract) with the buyer who would have been "Fred Smith" and no-one else, specialy not with the two posters here. The two posters have entered into a contract with the Ebay sellers and this is where ALL liability lays.
The Sale of Goods act doesn't cover private sales, which are effectively 2nd user sales. It's a case of buyer beware unless the item is faulty from the outset.
In this case, 'Fred Smith' has a duty to accurately describe something he is selling, but once accepted by the new owner his liability ends, even if it was technically a sealed box sale.
HTC have accepted responsibility for these sort of warranty claims in the past under their pan-european warranty, but they have no legal obligation so to do.
If a foreign buyer buys a T-Mobile phone, and it later goes wrong, his only other option is to contact the seller and see if he will negotiate with T-Mobile as a goodwill gesture.

Buying nexus one from ebay

Hi
Just wanted to know how warranty is handled with the nexus one bought directly from google: is it activated automatically so I don't need the receipt anymore, do I have to do this myself, is the warranty outside US supported or not? What do I need from the seller beside the device itself? And do I have to activate the device with google? First android phone not from HTC...

Not sure if this applies to Nexus One, but I had other HTC devices purchased from eBay and the warranty did apply to them.
They check warranty status via serial number, so you don't really have to have anything else.

If you get a problem tell them it was purchased as a present and they should update the details.

The nexus one is made by HTC.
Its activated automatically (no receipt needed).
It is tied to the serial # (rather than the owner or an address).
Ring HTC and they will tell you how long it has left. (Think my N1 came with a 2 year warranty)

I'd go with buying from Amazon. HTC sells an unlocked version of the N1 at a deal. Not sure if it is TMo or ATT. You might want to check on that. Good luck!
got my N1 from ebay. no receipt as it was upgrade from vodafone. I rang htc, gave them imei and they said no problem, I still have regular warranty.

Insurance Claim

So, after dropping my device and totally obliterating the screen, I put a claim in and after 3 weeks ended up getting a brand new device (this is also paying 0 excess, for reasons unknown to me, clerical error?) and noticed something interesting.
The box was fully sealed, albeit being mainly German or dutch on the back, no signs of it being a refurbished device, all new, yet when turning on and going straight into the bootloader, I was greeted with Cotulla HSPL 2.08!
So how can this be? Someone from the insurance company putting newest rom/radio on maybe? (Was 2.15 radio and 3.14 wwe, I was expecting preloaded t mobile UK rom)
Like I said no signs of being a refurb, so anyone with any ideas?

If the terms and conditions of your insurance is new for old, then contact the insurance company and get it replaced with a new one.
The supplier they got it from probably also deals with refurbs so chances are you got sent the wrong one.
Happens a lot with insurance claims.
Could be something as simple as previous owner bought it, tried the new rom, saw WP7 was coming out and returned it in 14 days.
Couple of years ago someone went into a T-mobile shop to buy themselves and their wife new phones, got home and was setting them up and discovered loads of photos of someone's partner naked. Thankfully as the wife knew they were straight from the shop he wasn't in the dog house, but it could have been very nasty.
Shop assistants response when they returned to complain they hadn't been given new phones "Well we can delete the images if you like"
Hmmm looking in settings, device information both call counters are zero, so if it is a refurbished device wasn't used at all, what lead me to believe it is a new device
So it's been hard reset then.
By refurb I also mean returned phones that have no faults but cannot be sold as new.
If it works and you're happy, I'd keep it.
I thought the internal call counters couldn't be reset?
Only saying that based on several threads here asking how to reset them and being met with negative replies (such method could be used to con people into thinking the phone wasn't used at all, hence more in selling price etc)

Bit later on someone says their counters were reset with hspl.
Basically, if Cotulla HSPL 2.08 has been installed by a previous owner, it's not a "new" phone.
It's history could be anything, such as someone got a new phone, knew about not liking the stock rom, installed HSPL then lost their job/gf/got better deal on a different phone, and returned it within the 14 days.
Phones that are returned cannot be sold as new, so they're sold on to insurance suppliers.
GF works in insurance and it happens all the time.
I've even had a TV replaced (new for old supposedly) with a damaged remote which was dented in one place and some of the buttons didn't work, insurance company claimed it must have been damaged in transit (impossible given the location on the keypad and shape of damage) and they'd send me a new remote. They never did, but I used an all4one so wasn't a problem. Took the old remote apart and the PCB was cracked where the dent was and someone had soldered wires across it.
The only way of being pretty certain you're getting new for old is to buy the replacement yourself (hoping the shop supplier hasn't messed up and sent them a returned product) and claim back off the insurance company, who of course don't like doing that as it costs them a hell of a lot more for you to buy a brand new phone than for them to buy a returned phone.

I dropped mine in a toilette and was told, after shipping it in, that the water damage voided the warranty (I had left TMoUS and was using it on AT&T so this was through HTC as TMoUS said they couldn't help). HTC said that they couldn't fix it & shipped it back charging me $15 for looking at it. The unit that showed up looked like mine- same ware pattern on the battery cover, but a much newer IMEI #- it came locked & my code didn't work is how I discovered this. So I either got new guts or my old battery cover on a refurbish-returned unit. I have to say, love-u HTC & Thanks.
-My USAA Homeowners insurance was ready to cover it under my computer clause, but that is supposedly changing soon.
